ORIGINAL -PUBLIC FILE <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: ti+-~nn~-nt~ <br />INSPECTION DATE: 'i!3/nx INSPECTOROS INITIALS: ~_ <br />OBSERVATION <br />The Division attempted to conduct apre- operational inspection of the site on 3/2/06. Present during the <br />inspection was Ms. Ronda Neumesiter, the operator. The site is being proposed to be 1 12 sand and gravel <br />covering 49 acres in one 17, and two 16-acre parcels. The site is located approximately b miles North of <br />Walsenburg, Colorado. Permit Amendment sign was properly posted, However, the legal description of the <br />application identified the pit to be located in Township 27 South rather than Township 26 East. The error <br />probably was caused because the operator had an adjacent 1 1 1 permit in Township 27 South. Because the <br />Division had also sent the Notice with the wrong Township, a New Notice had to be sent ,which also changed <br />the Division's decision date. <br />Ms.Ronda Neumeisfer indicated that she had instructed her people to place the permit boundary markers as <br />required by the Rules but no boundary markers were placed. She was informed to have it in place and contact <br />the Division, so the inspection could be conducted and also waive her right to a 90 day decision, because the <br />Rule Requires the Division to identify the boundary of the proposed permit to be clearly identified, before a <br />complete pre-operational inspection is written and filed. She agreed to wavier her right to a 90 day decision <br />and submitted a written wavier on 3/3/06. She was also asked to properly place the boundary markers for the <br />1 1 1 permits. 1 1 1-permit recalamtion has to commence once the government contract is completed. She <br />stated that once the 1 12 application is approved, she plans to move the processed stockpile aggregate to her <br />1 12 permit affected areas and commence with the recalamtion of the 1 1 1 permit.
