III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was an aerial inspection of the New Horizon Mine conducted by Harry Ranney of the <br />DRMS. Aerial photographs were taken on August 28, 2007. Weather conditions were clear and <br />sunny at the time of the flight. Mike Boulay of the DRMS reviewed the aerial photographs. <br />Twelve photographs were taken during the flyover. The majority of the mine site was visible in <br />the photographs. Equipment was active in the pit azea. Coal was being loaded and hauled out of <br />the active pit area at the time of the flight. A significant amount of groundwater was visible in <br />the current pit. No problems were noted in any of the aerial photographs. <br />Roads <br />Most of the mine site roads were dry and appeared well maintained and in good condition. A <br />coal stockpile was visible in the photographs near the active pit. <br />HvdroloQic Balance <br />Sedimentation Ponds 007, 008, 009, and 012 were visible in the photographs. Pond 012 was the <br />only pond that appeared to be entirely dry. Ponds 007 and 008 were both retaining significant <br />amounts of water. Pond 009 was holding a small amount of water. Pond inlets and <br />embankments appeared stable. No problems were noted at any of these sediment pond locations. <br />Support Facilities <br />The shop, warehouse and storage areas were viewed. From the photos, these facilities and <br />perimeter areas of the site appeared to be maintained and no problems were identified. <br />Reve etg ation <br />The site was dry, however; vegetation was relatively green and appeazed in good condition. Hay <br />fields visible in the photos had been recently cut. The fields azound Pond 008 were being <br />irrigated by sprinklers. <br />
