III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />General Comments <br />This was a complete inspection of the McClane Canyon Mine, conducted jointly by Dan Mathews of the DMG <br />Grand Junction Field Office, and Henry Austin of the Office of Surface Mining Reclamation and Enforcement <br />(OSM). Mine Manager Gary Isaac was contacted prior to the beginning of the inspection (on May 23) and Chuck <br />Silengo of CAM was contacted near the conclusion of the inspection, but we were not accompanied by an <br />operator representative during the field inspection. Weather was clear and mild. Ground conditions were dry in <br />most areas, although there was standing water from recent precipitation or road watering in the in-ditch sediment <br />trap and several of the silt fence ditch outlets and culvert inlet sumps along the haul road. Coal was being <br />conveyed out of the mine and loaded onto trucks during the inspection. <br />Availability of Records <br />Most required records were on file and up to date through the 1st quarter, 2007. Exceptions were the current <br />bond document and the current insurance certificate. The bond document was in a drawer in Gary Isaac's desk <br />during the previous complete inspection, but Mr. Isaac was not in the office on May 24, and the bond document <br />was not located. Copies of both the Insurance Certificate and the bond document are on file at the <br />Division office and will be delivered to the operator for placement in the "Records" binders, to be readily <br />available for viewing during DRMS complete inspections. <br />Roads <br />Haul Road surface, ditches, and culverts were generally in good condition, although during the field inspection <br />the haul road and coal stockpile area was very dusty. The water truck was not operational, but had been <br />repaired and the travel areas were properly watered down before the inspection was concluded. <br />One drainage concern noted was the outlet end of Culvert "K", the 12" road culvert that outlets near the sediment <br />pond inlet. The culvert is functional, but the outlet end is compressed and needs to be pried fully open. The <br />culvert needs to be repaired and protective measures need to be installed to prevent future damage by <br />vehicles. <br />In addition, the upper segment of the road ditch on the north side of the road between the coal stockpile <br />area and the upper 30" road culvert inlet was partially silted in, and needs to be graded out. <br />Hydrologic Balance <br />East Salt Creek was flowing but there was no flow in McClane Creek at the time of inspection. <br />The sediment pond contained water, surface elevation approximately 6" below the gated spillway inlet. The <br />embankment appeared stable, with no evident settling or seepage. <br />SAE silt fences were all functional, but the construction dirt stockpile and topsoil stockpile silt fence segments <br />appear to be somewhat worn, and fabric was torn loose from the stakes in a couple locations. These silt fence <br />segments need to be replaced. <br />Collection ditch segment that runs from near the mine fan behind the shop on the portal bench was partially <br />silted in along the upper end, and some cable had been stored along the ditch. The ditch needs to be cleaned <br />out and graded. <br />
