III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection of the Seneca II-W Mine conducted on November 19, 2002 by <br />Mike Boulay and Dan Mathews of the DMG. Lori Smith of Seneca Coal Company was present <br />during the entire inspection. Weather conditions were sunny and cool. The majority of the mine <br />site was snow covered. Coal was being hauled from the mine at the time of the inspection. The <br />dragline was located in the South Area pit but was down and not in operation. <br />Availability of Records <br />W ith the exception of rile reclamation cost estimate, all required records were on file and <br />available for review at the mine site office. SCC shall obtain a copy of the most recent <br />reclamation cost estimate and retain this document at the mine office. <br />Haul Roads <br />The Tie-Across Haul Road was recently graded and well maintained. All other mine site haul <br />roads were muddy and partially-snow covered which restricted access to many areas of the site. <br />The South Area pit was accessible. The G Road was accessible up to the location of the D-Pit. <br />The D-Pit was snow covered but appeared stable with no significant azeas of erosion noted. <br />Hydrologic Balance <br />Site Ponds 005, 006, and the B-Pit pre-settling basin were inspected. These ponds were frozen <br />over and Pond 006 was the only pond discharging. Access to Ponds 009 and 015 was blocked <br />due to snow and very muddy road conditions. Pond 016 was viewed from above at the top of the <br />access road to the pond. This pond was full and frozen over, but did not appeaz to be <br />dischazging. Since the time of the last inspection, a small access road has been built to the <br />location of Pond 017_ Good progress has been made on the construction of the dam, and the <br />primary spillway has been installed. <br />Topsoil <br />The eastern perimeter of the South Area pit at the location of NOV CV-2001-002 was inspected <br />from a location south of the slide damaged azea. From this location, the site of the former slide <br />appears stable. The site was snow covered, but no new signs of erosion were noted. Please <br />continue to monitor this location and make any necessary repairs to ensure the stability of the <br />reclaimed slope. <br />
