III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Tom Kaldenbach of the Colorado Division of Minerals <br />and Geology. Tom Bird represented the operator during the records check, but did not go along on <br />my walk around the site. It was raining during the inspection. With the operator's consent, this report <br />was issued from the Denver office. <br />Availability of Records <br />All required records were available (see attached list). <br />Sistns and Markers <br />A mine i.d. sign was properly displayed at the entrance to the site. <br />Roads <br />The mine entrance road was well maintained. <br />Hvdroloaic Balance <br />The water levels in both ponds were more than 4 feet below discharging. The culvert connecting the <br />two ponds appeared in good shape. Pond embankments and inslopes appeared stable. The primary <br />and secondary spillways appeared in good condition on both ponds. <br />Rainfall during the inspection provided a good opportunity for observing the function of the mine's <br />sediment control system. The diversion ditches on either side of the surface facilities area were <br />carrying clean water around the area, as designed. <br />The swale in the road that directs yard and road drainage to the small pond was functioning properly. <br />Procession Waste <br />The waste pile showed no evidence of structural instability. The top of the pile was not excessively <br />ponding water. Rainfall runoff on top of the pile was flowing back away from the face of the waste pile, <br />rather than over the face. The face of the waste pile was not excessively Bullied or rilled. Ditches <br />were effectively diverting water away from the top of the pile. <br />Support Facilities <br />Fuel Tanks in the surface facilities area show no signs of leaks or spills, and have adequate spill <br />barriers in place. No problems were found in the surface facilities area. <br />Weed Control <br />The small patch of the weed whitetop (Hoary cress) found on the embankment of the west pond early in <br />the summer has been removed. <br />
