III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tony Waldron of CDMG <br />along with Basil Bear of Bruin Mining. The mine is active and is <br />currently permitted to produce 600,000 tons of coal per year from <br />the west mine and 1 to 1.5 million tons of coal from the main mine. <br />This inspection focused on an inventory of the structures on the <br />mine site. This was conducted as part of the mid-term review <br />process which requires that the mine's reclamation liability be <br />reviewed each 2.5 years. The inventory revealed that there are <br />several discrepancies between the list used to calculate the bond <br />liability and what actually exists on the ground. This information <br />will be used to re-calculate the reclamation liability during the <br />upcoming mid-term review. <br />Pond cleaning has been completed for ponds 2, 3 and 4. Due to <br />water inflow into pond # 1, the cleaning process was only halfway <br />completed. This pond will be finished next year during additional <br />pond maintenance activities. The refuse pond and the west loadout <br />pond were also cleaned out this year. These activities should help <br />the pond 1-4 series function much more efficiently and as designed. <br />The operator is still in the process of repairing the leaking <br />binwalls in this pond series and is now considering a pressurized <br />foam injection seal in lieu of the earthen embankment proposed in <br />technical revision 27. The revision will be kept open to handle <br />any design changes that occur with respect to the discharge <br />devices. <br />The refuse disposal was inspected and is in good condition. All <br />material that has been added recently has been compacted and cover <br />material has been added where appropriate. There is just a small <br />area on top of the pile to place any additional refuse before the <br />final cover material will added. The north area of the pile will <br />then be filled before opening up the new area to the east as <br />approved in technical revision 25. The current disposal capacity <br />is approximately 10,000 cubic yards. <br />This concluded the inspection. <br />
