C-85-010 <br />Permit No. C-034-81 <br />Dear Mr. Pendleton: <br />Enclosed are the documents you requested regarding the work <br />that was performed by Beavers Construction Company on the <br />sedimentation pond at our Red Canyon Mine. <br />As can be shown by the "Contractors Daily Report", Beavers <br />Construction Company had an excavator on site for ten (10) <br />hours on November 12, 1984. <br />In response to the Division's interpretation of Rule 5.04.5 <br />(2)(b)(i)(B), which in part states, "The duration and extent <br />of the potential or actual damage ...", we still maintain that <br />this refers to the length of time over which any damage event <br />occurred, not the length of time that the possibility of a <br />damage occurance existed. <br />Si~.E~erely, <br />r <br />Dal <br />Ass <br />DLF/clt <br />P.E. <br />al Manager <br />enclosures <br />
