(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1992-nF9 <br />INSPECTION DATE: n9/2n/nt INSPECTOR'S INITIALS: SAP <br />OBSERVATIONS <br />This inspection was conducted in response to a report from Colorado Department of Public Health and Environment <br />(CDPHE) that a diesel oil leak had occurred on the site sometime between mid-March and the end of April of 2001. The <br />operator has been working with CDPHE since the time of discovery of the leak in order [o comply with state regulations <br />concerning remediation. Present at the inspection were Kate Pickford, DMG, Carl B. Mount, DMG, and Connie Davis, <br />Aggregate Industries WCR, Inc. Weather at the time of inspection was clear, calm, and about 80 degrees. <br />In May, 2001, approximately 2,000 cubic yards of contaminated soil was excavated from the affected area and stockpiled <br />on the site. Ms. Davis indicated that the boundaries of the abatement excavation were set according to recommendations <br />by the consulting firm hired to oversee the abatement, The Paragon Group. According to Ms. Davis, the contaminated soil <br />stockpile was placed on some type of liner material. Ms. Davis did not know what type of liner was used. The <br />contaminated soil is being incorporated into asphalt produced at the site. According to Ms. Davis, CDPHE approved this <br />use of the contaminated soil. At the time of inspection, there was no sign of stained soil in the area that had been <br />excavated. <br />3. The abatement excavation was subsequently filled with fill material. Ms. Davis was unsure of the exact location from <br />which the fill material was obtained, but thought it was acquired from somewhere west of the excavation pit. It is <br />anticipated that during subsequent extraction activities, any remaining contaminated soil will be excavated. Any <br />contaminated soil that is subsequently excavated from the pit will be stockpiled and handled as was the material that was <br />excavated during abatement activities. <br />4. Prior to July 6, 2001, groundwater and free-phase product were pumped from the abatement excavation site and shipped <br />to Key Energy Services for treatment and disposal. Additional groundwater was pumped from the excavation site and was <br />stored onsite for use at the site. <br />5. Two groundwater samples were collected during the abatement process to test for contamination of groundwater. Five <br />monitoring wells were installed on July 9 and July 10, 2001. The wells have been sampled once since their installation <br />and will be sampled quarterly for a total of one year. Ms. Davis indicated that at no time was there visible evidence that <br />contaminants had migrated to the dewatering trench, and believes that this is still being monitored regularly, although <br />there are no formal monitoring parameters set for the dewatering trench. There is a large stockpile of asphalt to be <br />recycled which is located to the south of the monitoring wells. Ms. Davis was not aware of any groundwater wells near <br />the permit area which are used for drinking water. <br />6. At the time of the diesel fuel leak, the only inventory of the fuel in the AST was an endof-month measurement of the fuel <br />remaining in the tank in the form of a stick dipped into the tank. This procedure was also conducted when fuel was <br />ordered to fill the tank. Ms. Davis indicated that further monitoring has been incorporated in the form of a memo initiated <br />by her in August, 2001 including a form to be used to document fuel usage at the pump. At the time of inspection, Ms. <br />Davis was uncertain as to whether these forms were actually being used as requested by her. <br />7. During the inspection it was noted that the topsoil stockpiles are weed-covered and should be seeded. Ms. Davis <br />indicated that mining in the area should be completed and the topsoil spread and graded within one or two years. <br />8. This inspection indicates that Aggregate industries is making a genuine effort to rectify any contamination that occurred as <br />a result of the fuel leak. The company is working under the guidance of a consulting group. Ms. Davis was advised, for <br />future reference, that incidents such as this fuel leak must be reported to not only CDPHE, but also to the Division. A <br />report under separate cover will be sent to the operator indicating further action required by the Division. <br />
