(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1980-003 <br />INSPECTION DATE12-12-2003 INSPECTOR'S INITIALS SSS <br />OBSERVATIONS <br />This was a routine inspection conducted at the permittee s request, to observe corrective actions that were conducted in <br />response to problems noted in the October 29, 2002 DMG Inspection Report. <br />The mine identification sign was observed. The permittee indicated that some more corner boundary markers had been <br />placed, but that placement of additional markers must occur after the surveyor completes the updated maps with accurately <br />placed permit boundaries. The existing maps are very poor, and do not exhibit the acreage specified by the permit (9.6 acres). <br />New maps will reflect the correct acreage and accurate placement of the permit boundaries and be in compliance with the rules <br />and regulations. As specified in the previous report, please ensure the map meets the requirements of Rule 6.2.1(2), and 6.3.5 <br />(copy enclosed), showing and labeling all operation features including product stockpiles, waste rock stockpiles, topsoil <br />stockpiles, processing facilities, hazardous materials storage with spill containment, current highwall locations, etc. It would <br />also be very helpful if all adjacent disturbance is shown and labeled including pre-1976 mining features that have not been <br />affected by this operation and storage and equipment salvage areas that support the ranching operation and not the mining <br />operation. A technical revision including the new maps must be submitted to DMG by No laterthan February 7, 2004. <br />The lack of adequate maps and permit boundary markers remains a problem as specified on the third page of the previous <br />report and must be corrected as specified to avoid potential corrective actions. <br />The permittee indicated that spraying for noxious weed control occurred several times during this past field season. Verification <br />of spraying was not possible at the time of the inspection, due to winter conditions. No documentation or weed control plan was <br />submitted to DMG as specified in the corrective actions of the previous report. The permittee was instructed to submit invoices <br />or other documentation that weed control measures had been taken. Additionally, the permittee will submit a technical revision <br />that includes a weed control plan as specified in the previous report. This revision MUST be submitted to DMG no later <br />than February 7, 2004. The lack of a weed control plan remains a problem as specified on the third page of the previous <br />report and must be corrected as specified to avoid potential enforcement actions. <br />A 55' gallon drum and a couple of 5 gallon buckets reportedly containing hazardous materials have not been stored within <br />adequate spill containment, as was required by the previous report. These items MUST be either removed from the site or <br />stored within adequate spill containment. Photographic documentation of compliance with this corrective action must be <br />received by DMG no later than January 5, 2004. The lack of adequate spill containment remains a problem as specified on <br />the third page of the previous report and must be corrected as specified to avoid potential enforcement actions. <br />None of the above noted problems are reiterated on page 3 of this report, though all remain as problems, with revised <br />corrective action dates. Failure to meet these SECOND CHANCE corrective action dates will most likely lead to <br />enforcement action hearings before the Mined Land Reclamation Board where additional corrective actions and <br />assessment of civil penalties could occur.
