III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Janet Binns of CDMG. The Grassy Gap mine is a reclaimed <br />surface mine. The mine permit and reclamation liability bond have been revoked by DMG. <br />Signs & Markers : DMG informational signs remains at intersection between Pit 2/3 road and Pit 5/6 road and <br />along the Pit 4 road. Main entrance gate at Routt County Road No. 27 was unlocked. DMG has been provided <br />with the current combination by Cross Mountain Ranch Manager, Mr. Phil George. <br />Roads : The access road from County Road 33 to the gas well was being graded at the time of this inspection. <br />The access road to Pit 5 and 6 remains in good condition. The access road to Pits 2/3 has developed gullies from <br />runoff and spring water flow. The road to Pits 2/3 is driveable part of the way to the reclaimed pits. Flow form <br />the spring along Pit 2/3 access road is diminished. Pit 4 access road remains drivable the entire way to the pit. <br />Some water cutting across the road has occurced. <br />Hydrologic Balance: Pit 5 spoil spring flow is reduced to a trickle. The Pit 5 spring pool is stagnant. Pond 5 <br />was discharging at a trickle. No additional slumping of the pond cut slope, or of the pond inlet was apparent. <br />The springs usually flowing alongside Pit 4 access road were barely flowing. Pond 4 was holding a small pool of <br />water several feet below the outlet elevation. A few weedy species, curlycup gumweed, and Canada thistle were <br />noted on the Pond 4 embankment. <br />Reve etation: Vegetation in Pits 5 and 6 are in good condition. Cross Mountain Ranch, the surface landowner, <br />has not used the property in their grazing rotation yet in 2004. A small patch of whitetop was noted along the <br />upland diversion ditch between Pit 5 and 6. Pit 4 vegetation was in very good condition. Pit 1 cover looked <br />healthy. Pits 2 & 3 vegetative cover was good. Cover in Pits 2 & 3 was sparser than that observed in Pit 4, but <br />rills were not plentiful nor were there many weedy species present. <br />Slides: No new slides were noted. The old slide to the west of pond 4 is healing and is almost hidden by <br />vegetation. No new gullies or erosional features were noted. Previously noted rills in Pit 1 and Pit 4 appear to be <br />healing with vegetative growth <br />
