r . 5' <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This partial inspection of the New Horizon Coal Mine was conducted by Wally Erickson <br />from the DMG Durango office, 484 Turner Drive, Building F, Suite 101, Durango, CO <br />81301, phone (970) 247-5193. Lance Wade, Western Fuels, accompanied the DMG <br />inspector throughout the inspection, <br />Hydrologic Balance -Sediment pond 007, located at New Horizon Mine #2, was holding <br />water, water depth was estimated at > 3'. Pond modifications, approved under recent <br />TR, were near completion. Pond discharge passes through V-notch weir. Operator <br />stated that Stevens Recorder was scheduled for installation for recording pond <br />discharge. Pond was discharging approximately 2 cfs, discharge appeared clear, no <br />sample taken. <br />Backfill & Grading -Backfilling and grading of active pit was current. Topsoil <br />replacement had occurred within 400' of active pit area. One power shovel was loading <br />overburden into two 95 ton trucks. Overburden was being utilized for Backfilling trailing <br />side of pit. Two dozers, were assisting in removal of overburden. Vegetation had been <br />removed ahead of the advancing pit highwall, approximately 300'. A and B horizons of <br />topsoil had been winrowed separately along leading side of pit highwall. Operator <br />stated that topsoil will be relocated with scrapers to reclamation side of pit as needed. <br />Side role irrigation equipment was observed on reclamation areas. <br />No evidence of recent settling was observed on reclaimed area. <br />
