III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This partial inspection of the Carbon Junction Mine was conducted by Wally Erickson <br />from the DMG field office in Durango, 484 Turner Drive, Building F, Suite 101, Durango, <br />CO 81301, phone (9701 247-5193. DMG inspector attempted to contact Mr. Jim <br />Hendricks, but was unsuccessful. Operations at the adjacent Ewing Mesa Gravel Pit <br />were active but no activity was observed at the Carbon Junction Mine. DMG inspector <br />did not encounter anyone during the time of this inspection. <br />Approximately 2 acres area immediately north of the permit boundary had been recently <br />cleared of vegetation. A trench, approximately 8' deep, had been excavated into the hill <br />side of the cleared area. Off site disturbance did not appear to be associated with <br />permitted coal mine activities. <br />SIGNS & MARKERS -Mine identification sign was posted at mine entrance. Public <br />access is controlled by gate and fence, gate was open. Public also has access to the <br />permit area along the east boundary, through a recently opened recreation hiking trail. <br />Information sign was posted on trail at east boundary, informing public of mining <br />activities and informing trail users of alternate routes, around the permit boundary. <br />Permit perimeter markers were observed. Topsoil signs were posted at topsoil <br />stockpiles. <br />ROADS -Gravel surfaced haul road and access roads were well maintained. Road side <br />drainage ditches were clear of debris and maintained to ensure sufficient capacity. <br />Culverts were well maintained and clear of sediment and debris. Minimum of 12" fill <br />existed over the triple culverts located at the north end of the equipment storage/mutual <br />use area. <br />HYDROLOGIC BALANCE -Evidence of disturbed area drainage escaping permit area was <br />not observed. Disturbed area drainage appeared to be sufficiently controlled to promote <br />stability and minimize erosion/sedimentation of affected areas. <br />Sediment pond 1 (south pond) was holding minor amount of water. Depth of <br />frozen water was estimated at 8". Primary spillway, located on north end of pond, <br />consisted of 12" CMP with 6' riser on inlet. Water level appeared to be 2' below the <br />bottom of the primary spillway pipe. Outlet of primary spillway was clear of sediment <br />and debris, outfall location appeared stable, no discharge noted. Secondary spillway, <br />located at south end of pond, consisted riprap lined open channel. Vegetation was well <br />established in secondary spillway. Secondary spillway appeared stable and did not <br />show evidence of discharge. Pond embankments were well vegetated and stable. <br />Riprap lining existed at both pond inlets. <br />Sediment pond 2 least pond) was dry. Cattails, willows and cottonwoods were <br />well established within and surrounding the pond. Sediment containment ditch which <br />conveys disturbed area drainage to pond 2 was well maintained. Sediment containment <br />ditch contained numerous rock filters which reduce velocity of flow and trap sediment. <br />Rock filters were constructed of irregular limestone and appeared to have been recently <br />installed. <br />
