III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />Track cut slope. This seep was a lot bigger last year before Bowie did repair work on the <br />Fire Mountain canal section just above the seep. <br />There was a moderate amount of water flowing through the culvert and one of the french <br />drains under the railroad tracks on the west side of the unit train loadout. The water was <br />coming from either the irrigated Feld above the tracks or though a seep in the Fire <br />Mountain Canal above the field. <br />Gob Pile <br />The top of the gob pile had positive drainage. The diversion, collection and road ditches <br />were functional. The underdrain was exposed in the back of the gob pile. The water baz <br />and road culvert at the entrance to the gob pile were functional. <br />Facilities <br />The operator is continuing the construction of the B-seam portal bench. The dirt and rock <br />aze being transported across the main haul road to the material storage azea. The upland <br />diversion ditch on the north and west side of the portal highway has been constructed and <br />riprapped. <br />There was a lazge amount of coal at the coal stockpile adjacent to Old State Highway <br />133. There was a dozer working on the top of the pile. Because the top of the pile was <br />being watered heavily, there was no fugitive dust problems. <br />Records <br />The records were found to be in compliance.
