<br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the New Horizon Mine was conducted by DMG staff from the <br />DMG Durango Office, 701 Camino De( Rio, Room 125, Durango, CO 81301, phone <br />(9701 247-5469. Ross Gubka accompanied the DMG inspector throughout the <br />inspection. <br />Mine identification sign and permit boundary markers were posted. <br />Pond 007 was holding water but water level was not sufficient to produce measurable <br />dishcharge, no discharge noted. Primary spillway was clear and functional, debris <br />guard and anti-vortex fin were intact. Pond embankment appeared stable, no evidence <br />of slumping, seeping or erosion observed. <br />Pit area was active. Overburden shot was observed. DMG inspector did not observe <br />any flyrock. <br />Reclamation backfill, grading and topsoil replacement appeared current. <br />
