Compliance with Colorado Surface Coal Mining Reclamation Act <br />CRS 1973, as amended 34-33-101, et. seQ., <br />and the <br />Rules and Re ulations Issued Pursuant to the Act <br />This includes a listing of the oar titular provisions of the regulatory program which were <br />examined during the course of this inspection, and identifies enforcement actions taken <br />during the inspection for failure to comply with the Rules and Regulations, the Act ands <br />the permit. <br />4.02.2 Mine and Permit ID Sign <br />The signs are in place and in compliance. <br />4.03 Roads <br />Roads appear to be in good shape. Entrances and exits of culverts have been adequately <br />riprapped. The six culverts at the haul road have considerable riprap placed. at the <br />entrance. This should not cause significant reduction of flow through them. The riprap <br />will at most, reduce the entrance velocity, causing minor deposition before the water flows <br />through the conduit. <br />9.05.3 Diversions and Conveyance of Overland Flow <br />The ditch from Pond A to Mann Draw has been regraded as requested in the last inspection <br />report. Snowcover prevented an accurate assessment of its design. <br />4.05.5 Sedimentation Ponds <br />Topsoil and subsoil excavated adjacent to the Pond H embankment has caused concern over the <br />embankment's stability. This excavation has in effect increased the heighth of the <br />embankment and reduced the needed foundation support. The excavation will also cause ponding <br />to occur on the downstream side resulting in fill saturation on both sides of the embankment. <br />The problem is further compounded since parts of the embankment were made from topsoil with <br />some vegetation. Vegetation and/or topsoil reduces the cohesive forces of the dam by acting <br />as a kind of lubricant within the Embankment. This material also allows more seepage <br />through the embankment since it is more permeable. Because of the problems noted above <br />the Division requires that the excavation be filled in to remedy the problem. Attached to <br />this inspection report is a recommended procedure the operator may follow to correct the <br />situation. If the operator disagrees with the procedure he has the option of doing a stability <br />analysis of the embankment and submitting to the Division an alternative plan. However, if <br />the operator choses this route he must submit alternative plans to the Division by <br />May 1, 2981. Because of the concerns raised here, the Division will require the situation <br />to be remedied before any spring runoff. <br />4.05.7 Discharge Structures <br />Riprap has been placed at the outlet of emergency spillways as requested. It appears <br />that exit velocities from the spillways will be high due to the spillway slope. This will <br />be reviewed in the permanent program application. Primary spillways are properly riprapped. <br />4.15.13 Surface Water Monitoring <br />The embankment for the parshall flume has been lowered as was previously requested. <br />(cont'd) <br />
