<br />Mr. Jim Stevens <br />Division of Minerals and Geology <br />March 30, 1999 <br />Page 2 <br />Bruce Smith, Water Commissioner from Waster District 11, inspected this pit azea with Lawrence <br />Nichols, Hard-Rock Plant Manager, and I am told that he informed Lawrence that there was no <br />problem with this operation. It was not a compliance issue as faz as Water Resources was concerned. <br />He is supposed to be sending a letter to Lawrence on this. As soon as it is received, I will send you <br />a copy. I understand the same Division request for review by the Water Commissioner was sent to <br />Kaess Contracting, Inc. (File No. M-78-193). 1 talked to the Kaess representative. He said Water <br />Resources took no corrective action and that none was required. It was called "tail water" from <br />irrigation. The applicant feels that this should end any concerns in this area. <br />The overhead utility line crossing the pit area was not cited as a possible correction item, but <br />deserved attention from the operator. The operator will be contacting the electric company for their <br />requirements and agreement for liability by the operator. <br />Item 3. Supplement the 1997-98 Annual Report and supply the information required. <br />That report stated that there had been no changes. That was meant [o mean, in the mined area, which <br />did not necessitate any map changes. Part of the pit area was re-disturbed and the material was <br />hauled to the Main Plant south of Salida. There is no intent to cease operations at this pit. <br />I am suggesting to the company that they be more complete in their explanations in their annual <br />reports. <br />[ believe this addressed all the Corrective Action requirements, as well as the other issues discussed. <br />A copy of the agreement with the electric will be supplied to you as soon as received. <br />Call me if there aze any questions.
