Long <br />Division Director <br />The Colorado Division of Minerals and Geology acknowledges the receipt of the OSMRE Somerset <br />Mine oversite inspection report. Corrections and comments to the inspection report are listed <br />below. <br />- The date of the last state complete inspection, prior to the oversite inspection, is B/5/92 <br />not 5/5/92 as stated in the report. The four required quarterly complete inspections for <br />1992 have been conducted. <br />- Item Number 5 of the Identified Violation Data Section shows that the "failure to pass" <br />violation was present at the last state complete inspection (LSCIj. This is incorrect. The <br />new pond construction, which resulted in the filling of the old pond, began over one month <br />after the LSCI. <br />- Items Number 3 and 4 in this same section indicate "other" as cause of violation. The <br />Division maintains that "Permit Defect" is the proper cause for these items. <br />Notice of Violation C-92-033 was issued October 30, 1992 for failure to pass. <br />Notice of Violation C-92-034 was issued October 30, 1992 for failure to properly store <br />non-coal waste. <br />If further information or clarification is needed, do not hesitate to contact me. <br />Sincerely, <br />~V <br />Steve S.
