Long
Division Director
The Colorado Division of Minerals and Geology acknowledges the receipt of the OSMRE Somerset
Mine oversite inspection report. Corrections and comments to the inspection report are listed
below.
- The date of the last state complete inspection, prior to the oversite inspection, is B/5/92
not 5/5/92 as stated in the report. The four required quarterly complete inspections for
1992 have been conducted.
- Item Number 5 of the Identified Violation Data Section shows that the "failure to pass"
violation was present at the last state complete inspection (LSCIj. This is incorrect. The
new pond construction, which resulted in the filling of the old pond, began over one month
after the LSCI.
- Items Number 3 and 4 in this same section indicate "other" as cause of violation. The
Division maintains that "Permit Defect" is the proper cause for these items.
Notice of Violation C-92-033 was issued October 30, 1992 for failure to pass.
Notice of Violation C-92-034 was issued October 30, 1992 for failure to properly store
non-coal waste.
If further information or clarification is needed, do not hesitate to contact me.
Sincerely,
~V
Steve S.
