III. Comments -Compliance <br />Below are particular issues with regard to any of the compliance items. <br />Enforcement actions resulting from failure to comply with the Act, Rules <br />and Regulations, and the permit also are Identified below. <br />Hvdroloaic Balance - Rule 4.05 <br />1. The small area exemption from sediment ponds at the railroad <br />car load-out was discussed with Mr. Chilton. It 1s recommended that rock <br />check dams or slit fences be placed at both ends of the drainage area <br />near the load-out hopper upgradient from the culverts at both ends. This <br />would eliminate any chance of coal fines entering the undisturbed <br />drainage system. <br />2. The drainage ditch north of the fines stockpile was partially <br />filled in with sediment. This ditch will require maintenance soon. <br />Reveaetation - Rule 4.15 <br />Some germination was noted on areas seeded last fall. <br />
