III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was an aerial inspection, flown on March 9, 2001. The digital image was reviewed on <br />March 13, 2001. There were no compliance problems observed during the overflight. The <br />loadout was free of snow, although the azea did have some standing water. <br />Facilities <br />There were about 30 railcars at the loadout, awaiting loading. The county road was not blocked <br />by the railcars. The operator has stockpiled coal on the west side of the facilities bench and a <br />lazge amount of coal just east of the grizzly. There were no coal haul trucks unloading at the time <br />of the inspection. There were no apparent problems with fugitive dust. <br />There did not appear to be any leakage problems at the fuel facility. Coal refuse is being stored <br />temporarily just east of the fuel facility, for later transfer to the Sanborn Creek Mine refuse pile. <br />There were no problems at the material storage area or anywhere else around the loadout area. <br />Roads <br />The roads appeared to be dry and in good shape. The east gate was closed. <br />To soil <br />There did not appear to be any erosional gullying at the topsoil stockpiles. <br />Hydroloay <br />It appears that the operator has cleaned out pond number 1.
