III. Comments - Compliance

Below are particular issues with regard to any of the above compliance items. Enforcement
actions resulting from failure to comply with the Act, Rules and Regulations, and the permit
also are identified below.
Availability of Records (5.02.4)
The water monitoring records were checked. They are in order. The. latest report is
for June, 1982. Monitoring for this quarter has not yet been conducted. Monitoring
should be conducted before the end of November.
Roads (4.03)
The roads were very wet and muddy. Road culverts were covered with snow and could not
be checked. The drainage from the road appeared to be flowing properly. No excessive
ponding of water was noted.
Hydrologic Balance (4.05)
The upper diversion ditch was inspected and appeared in good condition.
The collection ditch around the perimeter of the mine yard was filled with snow.
Drainage from the yard was flowing into the ditches or directly into the pond. There
was some water in the pond but not enough far a discharge.
Water monitoring needs to be conducted in November as addressed in the previous
section of this report.
Revegetation (4.15)
The embankment of the portal bench was broadcast seeded by the operator from the bench
and from the county road. The outslope of the collection ditch was intended to be
seeded at the same time. However, the snow depth on the embankment was enough [o
impede seeding success. Therefore, I recommended that the operator not seed until
there was less than two inches of snow on the embankment The operator concurred.
The area should be seeded as soon as conditions allow, but prior to November 30, 1982.
General Compliance with Mine Plan
The storage yard near the intersection of the ranch road and the county road has not
been disturbed.
