III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DMG. Bill Bear represented <br />the operator. A snowfall of about 2.5 feet covered the mine site a couple of weeks ago. At the time of <br />the inspection, there was about a 1 foot cover of snow. <br />Facilities <br />Construction continues at the wash plant site. The cut slopes are finished and no signs of slope failure <br />were observed. The concrete foundation for the wash plant building has been poured. The buildup of <br />the gob pile haul road is complete. Now the surface has to be graveled. The road berm was in place. <br />The gob pile haul road was built up against most of the embankment of Pond C. The discharge pipe for <br />Pond C now runs under the road through a culvert. The discharge point for Pond C has been moved to <br />the other side of the road, just west of Pond D. <br />The concrete foundation for the new stacker tube has been poured on the west side of the coal stockpile <br />bench. The stacker tube will be part of the new wash plant system. The temporary road that is being <br />used for access to the construction site has been graveled but the construction area was muddy due to <br />the recent snowmelt. Truck tires have carried a little mud onto the paved road. The operator will clean <br />these mud tracks up this week and continue to keep this area clean. This section of the paved road <br />drains back to the ditch that leads to Pond B. Straw bales also need to be placed around portions of this <br />site to prevent any future sediment problems onto this section of the paved road should there be a rapid <br />snowmelt. The temporary road could also use a Swale at the bottom to better direct snowmelt water to <br />go into the ditch that leads to Pond B. <br />Some of the excess excavation material was transported to the highway coal stockpile at the Bowie No. <br />] Mine. The rest was placed on top of and behind the covertill stockpile at the Bowie No. 2 Mine. The <br />double row of straw bales at the base of the coverfill stockpile will be replaced soon as normal <br />maintenance. <br />The three mains for the new B-seam portal have progressed about 250 to 300 feet into the slope. The <br />gob material from the mains development is being placed at the gob pile. <br />Gob Pile <br />The gob pile was in good condition. The top of the gob pile had positive drainage. There were many <br />small piles of gob from the B-seam portal development work that had been placed on top of the pile for <br />drying. The underdrain was exposed at the back of the pile as designed. However, refuse is getting a <br />little too close to the exposed end of the underdrain and should be kept away from it. The Swale and <br />culvert at the entrance to the gob pile were functional but could use a little maintenance. <br />c aword/bowie2/insp0104 <br />
