III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />Notes: <br />Mr. Harry Ranney, Environmental Protection Specialist (EPS) of the Division, took 10 aerial <br />photographs of the mine site on September 26, 2002. This report is compiled by Byron G. <br />Walker, EPS, based on an oral debriefing of, and a review of the photographs taken by, Mr. <br />Ranney. Mr. Ranney stated that he saw no problems at the site. No items of noncompliance <br />are apparent in the photographs. Photographs are numbered 25-02-09-26--109 (109) through <br />25-02-09-26-1 18 (1 18). Copies of all the photographs are attached as part of this inspection <br />report, and are on electronic file at the Division. Comments are necessarily limited to the scale <br />and detail of the photographs. The Loadout Area was not covered by this inspection. <br />ROADS Portions of the permanent road into the Portal 1 facilities area appear in Photographs <br />111, 112, and 114, through 117. It appears to be in good repair. Portions of the road to the <br />Stoney Ridge Fan Shaff appear in Photograph 110. It appears to be in good repair. Portions of <br />reclaimed roads to the north of Pitkin County Road 1 appear in Photographs109, 110, 114, and <br />115. This reclamation appears to be in good repair. <br />HYDROLOGIC BALANCE The waste area sediment pond appears in Photographs 113, 114, and <br />118. It appears to be dry and in good repair. The sediment pond P-9 appears in Photographs <br />112, 114, 116, and 117. It appears to be dry and in good repair. Ponds T-1 and T-2 appear to <br />be full (Pictures 112, 114, 115, and 1 16, 164) as does the Long Pond (Photographsl 11, 112, 114, <br />115, and 116). All of these impoundments appear to be in good repair, and operating <br />properly. The permanent relief drains off the waste pile area appear in Photographs 113, 114, <br />and 118. They appear to be in good repair. The permanent drainage across the reclaimed <br />facilities area appears in Photographs 111, 112, 114, 115, and 116. It appears to be in good <br />repair. The permanent ditch from Pond P-9 to the refuse area pond appears in Pictures 112, <br />113, 114, 116, 117, and 118. It appears to be in good repair. Colorado Discharge Pollution <br />Elimination System (CDPES) discharge points (outFall) 001 appears in Photographs 112, 113, 114, <br />116 and 117. CDPES Outfall 005 appears in 113, 114, and 118. No adverse impact to the <br />hydrologic balance of the site is apparent in the photographs. <br />PROCESS WASTE The waste disposal site appears in Photographs 113, 114, and 118.
