A site inspection was made of the Chaparral Meadows Pit, located 5.3 miles east of
Hartsel, Colorado along County Road 59.
2. The inspection was conducted as a possible illegal since there was n entrance sign or
boundary markers as required by Rule 3.1.12 and there was no operator pr sent. Mr. Downare
did appear toward the end of the inspection to inquire about this inspe tor's activities.
The Division requests that the operator post an entrance sign and ide tify the 9.7 acre
boundary as required by Rule 3.1.12 within 60 days. See page 3 for details.
3. The Chaparral Meadows Pit is permitted for 9.7 acres of disturbance. The financial
warranty is a $5,000 Certificate of Deposit. The post-mining land use is agriculture. The
land surrounding the pit is currently used for grazing buffalo and/or li estock.
4. This inspector measured a total disturbance of approximately 15 acr s ( 720' x 900').
The disturbance consist of 60~ pit disturbance and 40~ minimal disturbance The pit has been
excavated 6-8'. These measurements compared to the 9.7 acre permit boun ary as defined in
the permit application clearly indicate that mining has occurred outside t e permit boundary.
The Division therefore considers this action to be in violation of Rule and
will send a Reason To Believe letter to the operator. See page 3 for de ails.
5. It is also clear that the $5,000 financial warranty is inadequa a to reclaim the
Y ~~ Y~ P g
/! it~rriQaw~ 7~ ~.5; 0Oo
I & E C~~ ontact Address cc: Jim Stevens, DMG
^ CE Sd00
NAME Vaughn DownareDOwnare ^ BL
OPERATOR Downare Land & Cattle ^ FS
STREET P.O.
