Specialist: Allen Sorenson <br />Location: Sec. 12, T1N, R72W, 6th PM, Brisling Bond: $46,215.00 <br />Boulder County <br />:Nature and Duration of Violation: <br />On August 28, 1995, the Division directed the operator to repair all tailing <br />pond liner flaws and defects using an extrusion welding apparatus. The <br />Division further directed the operator to vacuum test all repairs, and to <br />,provide the Division with a set of technical specifications detailing the <br />repair and vacuum testing procedures to be employed. in consultation with the <br />operator, a deadline of November 1, 1995 for completion of the repairs was <br />established. During a Discussion Item convened on November 15, 1995, the Board <br />was notified that the repairs had not been completed. The Board then Ordered <br />the operator to complete the liner repairs by November 20, 1995. When the <br />liner repairs were not completed by the deadline established by the Board, a <br />Notice of Violation was issued (NOV /( M-95-078 issued by the Board on <br />12/14/95). Corrective action specified was to complete liner repairs and <br />vacuum testing, and to provide independent certification for the repairs. As <br />of this date, the required corrective action has not been completed. Three violations have been issued to this operator, at this <br />site under the old permit, during the past 12 months. <br />Staff Recommendation: <br />Cease and Desist: <br />Modify the Cease and Desist Order to specify a February 16, 1996 deadline for <br />completion of the corrective action. If corrective action is not complete by <br />February 16, 1996, the Board will consider permit revocation at the February, <br />1996 meeting. (COM, Inc. has provided a written waiver of their right to a 20 <br />day hearing notice for consideration of permit revocation). <br />Corrective Actions: <br />Complete and vacuum test all liner repairs to the satisfaction of the Division. <br />Provide independent certification from a person or firm experienced in quality <br />assurance for flexible membrane liners that the repairs have been completed and <br />tested in accordance with accepted industry practices and standards. <br />Civil Penalty Range $50 - $200 per day.
