111. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the inspection. <br />Comments also describe any enforcement actions taken during the inspection and the facts or evidence supporting the <br />enforcement action. <br />This was a complete inspection of the Sunlight Mine conducted by Erica Crosby of DMG. No <br />company representative was present during the inspection. The Sunlight Mine status is revoked. <br />Weather and ground conditions on site were clear and dry. <br />Roads The upper portal road was blocked with a berm to prevent access to the site. The lower road <br />is well vegetated. Both roads are in marginal condition due to the amount of coal and rills on the <br />road. <br />Hydrologic Balance The sediment pond was dry, and no recent discharge was noted. The pond <br />embankment is well vegetated. The upper diversion ditch is starting to fill with sediment on the lower <br />end. The ditch section above the portal is in good repair, and appears to be diverting runoff around <br />the portals. <br />Backfillinc~& Grading The crib wall status has not changed since the previous inspection. Some <br />timbers were loose, and erosion was noted through the spoil. The backfilled portals were stable, and <br />no subsidence features were noted. The lower fan portal contain water roughly one foot in depth. <br />The water was contained in the portal area. <br />
