(Page 31 <br />MINE ID # OR PROSPECTING ID #: M-1984-069 <br />INSPECTION DATE: 9-13-07 INSPECTOR'S INITIALS GRM <br />Inspection 9!13/07 <br />The mine identification sign and affected azea boundary markers are in place and in compliance with Rule 3.1.12. <br />The sign is located on a post at the entrance to the mine site. Permit boundaries are flagged rebar pins at corners of <br />the permit azea and strategic points that are clearly identifiable. <br />The inspector notes general mining equipment of a portable stacker and a dozer on site. There has been some <br />activity on site as the stockpile of processed materials has been reduced since the October 2006 inspection. <br />Highwalls are less than ] 0 feet high and stable. <br />There appears to be no stormwater issues at the site. The pit is surrounded by a minimum two to three foot berm <br />that is along the permit boundaries. The general grading is towards the center of the pit which has an approximate <br />20 foot X 30 foot retention pit. No water was noted in the pit at this time. The inspector noted no indications of <br />contamination residue in the pit such as an oil line, odd odor or soil discolorations. Vegetation growing within the <br />retention pond indicates no disturbance of the soils in this area recently. <br />There are no petroleum products, chemicals or other hazazdous materials noted on site. The site is free of debris or <br />unnecessary mining equipment. <br />The inspector walked the entire perimeter ofthe permitted azea and out approximately 200 feet beyond. To the west <br />is a road owned by the land owner and a rifle shooting area for private use. Beyond that is undisturbed sage land. <br />To the north some fifty feet is an intermittent drainage. A few scattered cottonwoods, willows and grasses are <br />within the drainage that heads easterly. A retention pond constructed by the adjacent landowner appears to catch <br />run-off just off the Schmalz property. The adjacent landowner's house is approximately 500 feet to the east ofthe <br />permit boundary. Mr. Whitley's residence is approximately a half mile east of the pit boundary and not visible due <br />to a ridge that is directly between the two sites. To the south is the entrance to the Shmaltz property. Just past the <br />gate is equipment and structures not related to the mining operation. It should be noted that in 2003 there was a very <br />large number of equipment and portable units in this area that have been subsequently removed and the area has <br />been cleaned up very well. This is the area where materials have recently been imported for a planned level working <br />area. The materials are outside the permit azea and not associated to the mining operation. However, the inspector <br />notes the material is typical river run consistency of overburden mixed with cobble of various sizes. The operator <br />noted the material is waste rock from a project at Western State College and not from the Gunnison street project as <br />claimed. The inspector did not observe any materials that are consistent with mill tailings of any kind. Some waste <br />asphalt was noted in the pile. The asphalt is old and by Division standards safe For high /dry fill material. A small <br />drainage was noted in this area that cuts between the equipment storage area and the permit. The inspector walked <br />the drainage close to the permit and did not note any indications of contamination much like the observations of the <br />in pit retention area. No off site damage related to the mining activities was evident. <br />No significant infestations of noxious or other problematic weeds were noted on site during this inspection. <br />The reclamation cost estimate was not recalculated as part of this inspection. The current estimate was recalculated <br />less than three years ago and the operation is in compliance with the approved mine plan and reclamation plan. <br />Therefore, the current financial warranty is believed to be adequate to reclaim the site per the approved reclamation <br />plan. <br />
