III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The Comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Kaldenbach of the Division Minerals and Geology. <br />The Division is reviewing Phase III (Final) bond release application SI,-5 for the site. A bond release <br />inspection was conducted in September 2004. <br />Much of the site was covered by a few inches of snow. Jerry Koblitz of Greystone Environmental <br />Consultants, Inc. represented the operator during the inspection. At the end of the inspection I briefly <br />discussed the bond release process with Jerry and Mel Martinez (the landowner). The three attached <br />photographs were taken during the inspection. With the operator's consent, this report was issued <br />from the Denver office. <br />Slides and Damage <br />The operator had afour-man crew on the site that was completing shaping of head-cut areas of gully <br />channels, as recently approved in Technical Revision TR-34. The work was being done with hand- <br />tools. The crew had completed restoration of other permanent structures (the inlet of culvert C-5 in the <br />Revision 1 area and the slope around the outlet of the double-culvert underneath the road on the west <br />side of East Pit). The shaping of head-cut aeeas completed the work approved in TR-34. The <br />restoration work satisfied the requirements of 4.05.17. <br />Reclamation Success <br />The locations of the following monitoring wells were checked for completion of reclamation: W-6, <br />W-9, W-10, W-16, W-17, and W-18. No evidence of the wells was found at any of the locations. All <br />sites were well-vegetated. The operator has recently submitted well abandonment reports to the <br />Division indicating all required reclamation was completed on monitoring wells several years ago. <br />Based on the observations made during this inspection, the monitoring wells have been successfully <br />reclaimed. <br />The locations of the four former ponds were also checked for reclamation success. The ponds were <br />reclaimed several years ago. All four locations were well-vegetated, have no erosion problems, and <br />blend into the surrounding landscape. <br />
