III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This partial inspection of the New Horizon Mine was conducted by DRMS staff from the Durango <br />Office. One photo accompanies this report. <br />Snow cover of approximately 3 inches existed throughout the area. Mining and reclamation activities <br />were active. Backfilling, grading and topsoil replacement appeared current for the reclamation side of <br />the pit (panel 80). Topsoil had been salvaged from the advancing side of the highwall prior to removal <br />of overburden. Approximately 150 elk and 20 cattle were observed in the fenced and reclaimed areas <br />within the watershed of Pond 7. Numerous varieties of waterfowl were at Pond 7. <br />The shallow depression in the reclamation area located adjacent to an irrigation supply line, identified <br />in the report generated from the August 17`h inspection, was not inspected. <br />No problems or possible violations were observed <br />
