III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Kaldenbach of the Colorado Division of Minerals and <br />Geology. This was also a Special Focus oversight inspection conducted by Henry Austin of the Office <br />of Surface Mining. The Special Focus topic was contemporaneous reclamation. Ross Gubka and <br />Tony Adkins represented the operator. The ground was dry. With the operator's consent, this report <br />was issued from the Denver office. <br />SIGNS AND MARKERS: <br />Topsoil markers were properly displayed on topsoil stockpiles immediately west of the pit. <br />Air Resource Protection <br />The operator recently applied magnesium chloride to haul roads. Dust was under control on the site. <br />General Mine Plan Compliance <br />As part of the Special Focus inspection on contemporaneous reclamation, we examined the azea seeded <br />in 2004 (sideroll 9 azea, see Photo 1) and the area of active backfilling next to the pit. Backfilling, <br />grading, and topsoil replacement were being conducted concurrent with mining, as specified on permit <br />page 2005.4(2)(c)-1. In the past the operator has live-hauled topsoil. Stockpiling of topsoil will be <br />necessary until the Road 27 alignment is backfilled up to final grade. <br />
