III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made during
the inspection. Comments also describe any enforcement actions taken during the inspection and the
facts or evidence supporting the enforcement action.
This was a partial inspection conducted by Tom Kaldenbach of the Colorado Division of Minerals and
Geology. This was also a Special Focus oversight inspection conducted by Henry Austin of the Office
of Surface Mining. The Special Focus topic was contemporaneous reclamation. Ross Gubka and
Tony Adkins represented the operator. The ground was dry. With the operator's consent, this report
was issued from the Denver office.
SIGNS AND MARKERS:
Topsoil markers were properly displayed on topsoil stockpiles immediately west of the pit.
Air Resource Protection
The operator recently applied magnesium chloride to haul roads. Dust was under control on the site.
General Mine Plan Compliance
As part of the Special Focus inspection on contemporaneous reclamation, we examined the azea seeded
in 2004 (sideroll 9 azea, see Photo 1) and the area of active backfilling next to the pit. Backfilling,
grading, and topsoil replacement were being conducted concurrent with mining, as specified on permit
page 2005.4(2)(c)-1. In the past the operator has live-hauled topsoil. Stockpiling of topsoil will be
necessary until the Road 27 alignment is backfilled up to final grade.
