III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />Genera] Mine Compliance <br />During inspection of the pit area it was noted that a substantial amount of solid waste had been <br />dumped into the east side of the pit onto a bench where spoil material was being replaced. It was <br />evident from tire tracks that a large truck had dumped the load of trash recently into the pit. <br />Mine personnel indicated that this type of activity is not a practice of the mine and that it had <br />likely been discarded by an employee with access to the mine. Photograph Numbers 1 and 2 at <br />the end of this report shows the trash dumped into the pit azea. The trash was inspected and <br />found to contain scrap metal, wood, household trash and two empty rusted 55-gallon barrels. <br />There was no evidence of any oil and grease, flammable or hazardous materials. There was <br />household trash which indicated that the probable source of the material was from an employee's <br />home. Photograph Number 3 shows Ross Gubka of WFC inspecting the trash. Based on this <br />information, it was cleaz that this was not an action taken by the mine that resulted in the trash <br />being dumped into the pit. Therefore a notice of violation would not be issued so long as the <br />mine took immediate actions to remove the trash and dispose of it in an approved manner at a <br />legal landfill. <br />Prior to the end of the inspection, WFC began making arrangements for a contractor to pick up <br />and dispose of the trash at the Broad Canyon Landfill, located close to the New Horizon Mine. <br />WFC provided the DRMS with cleanup photos and dump tickets that showed 26 yards of solid <br />waste material was received by the Broad Canyon Landfill. As shown in the photo provided by <br />WFC (Photograph Number 4) the trash was thoroughly removed from the pit. All of the trash <br />was disposed of at the landfill site within two days following the DRMS inspection as indicated <br />by the chazge tickets from the landfill. No further action is required by WFC and the issue has <br />been fully resolved. <br />
