<br /> <br />-2- August 17, 1983 <br />5.04.5(2)(c) - Fault ($250.00 minimum, $1,500.00 maximum). <br />This violation fits the category of negligence. There are mitigating <br />circumstances in that the operator had made attempts to grade the ditch <br />prior to the July Inspection, but was unable to schedule an equipment <br />operator. However, the operator (Grand Mesa) had been given at least two <br />weeks notice, since the ditch section was noted as a problem in the <br />Inspection Report sent out on June 2U, 1983. The deadline for abatement <br />set out in that report was July 15, 1983.
