I rF <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete quarterly inspection of the mine site and office records, conducted by Dan Mathews of the <br />DMG, Grand Junction Field Office. Tonya Hammond of SCC was present during portions of the inspection on <br />December 23. Weather was clear and cold both days. There was patchy snow cover on north facing slopes in <br />some locations, other areas were snow free. <br />Availability of Records <br />Required records were on file and up-to-date through the 3`~ quarter, 2004. A current insurance certificate had <br />been placed on file since the previous inspection. <br />Roads <br />Most permit area roads were in good condition. One exception was the light use road above the RSRDA borrow <br />area. The road had been traveled by equipment when muddy, and was rutted near the lower end. The lower <br />water bar and the berm at the very end of the road need to be repaired. The tracks apparently were made <br />by the power company, to access and replace a damaged power pole near the north perimeter of the borrow <br />area. <br />Also, there was a small "sinkhole" type settling feature on the light use road through the North Decline <br />Area, that will need to be repaired. The hole is approximately 200 feet down the road from the upper gate. At <br />the time of the inspection, the dimensions were approximately 4 feet long by 2 feet wide by 1 foot deep. <br />Hydrologic Balance <br />All of the sediment ponds were dry with the exception of Pond 1 &2 at the UTL, which contained a shallow frozen <br />pool. There was also a shallow puddle in the low area of the North Decline permanent channel. Small area <br />exemption sumps at the North Decline and the CBA-1 sump near Coal Creek were dry. <br />Small area silt fences and berms at the various required locations were in place and functional. <br />Minewater Discharge 016 was running clear, approximately 280 gpm, when checked at 2:00 PM on 12/22. <br />Collection and Diversion ditches at the various disturbed area locations were properly maintained and functional. <br />Backfill and Grading <br />Graded areas at the various reclamation sites appeared stable. The operator had stabilized a rill near the silt <br />fence at the North Portal reclaimed area, which had been noted in the previous inspection report. The rill had <br />been packed with loose straw. <br />Processing Waste <br />The three refuse areas appeared to be stable. Perimeter ditches, diversions, and terrace drains appeared to be <br />properly maintained and functional. The operator had satisfactorily addressed a maintenance item noted in the <br />previous inspection, regarding drainage at the RSRDA refuse area. A flex pipe had been placed to drain an <br />apparent low area at the northwest corner of the top of the refuse pile. The pipe would safely convey drainage to <br />the upper terrace drain, and prevent any ponding in the low spot. <br />Support Facilities <br />The portal openings at the South Portal area were properly secured. The portal area seeps were frozen <br />3 <br />
