Jeff Pridemore, of Pridemore Construction, was <br />present for the inspection. <br />The permit area consists of an upland bench in the north half, which ie situated <br />approximately 15 or 20 feet above the Arkansas River, and a lowland/wetland area to the south <br />ae you approach the junction of the Arkansas River and Maxwell Creek. <br />The access road from Highway 285 enters the upland part of the permit area which ie used ae <br />a facilities area. The required MLRB access sign was posted at the entrance of the pit. The <br />surface of the facilities area is graveled, there are several small product stockpiles, <br />equipment on site included a screening plant, a dozer, and a wheel loader. A pond has been <br />constructed at the break in elope from the upland to the lowland. The pond ie Eed from <br />springs located in the elope west of the permit area, and the pond overflows and discharges <br />to the wetland. <br />The operator has constructed a drainage ditch around the west aide of the site in order to <br />drain the wetlands to facilitate excavation. Topsoil has been pushed to the perimeter of the <br />excavated area in the wetlands. There ie.several feet thickness of good quality topsoil in <br />this area. This soil source will be used for reclamation of both the upper and the lower <br />areas. It was extremely windy at the time of this inspection, even eo, no blowing or erosion <br />of topsoil or other stockpiLea was observed. A small pond has been excavated in the lower <br />area, and has filled with groundwater. <br />OTHEA AGENCY CONCERNS <br />The operator ie impounding water from springs that flow above the permit area in the upper <br />pond. Groundwater has been exposed in the lower pond. Mr. Jeff Pridemore did not know if <br />the landowners water rights have been decreed for these uses, and a gravel pit well permit <br />has not been issued for this operation. A copy of this report is being sent to the Office <br />of the State Engineer (OSE). For the information of OSE, the following location information <br />is provided: NE, NE, Sec. 33, T14S, R78W, 6th P.M., Chaffee County. <br />The operator ie draining and excavating in a wetland, so a copy of this report ie being sent <br />to the Army Corps of Engineers. A Department of the Army Permit has not been issued for this <br />site, but Mr. Jeff Pridemore stated that the Army Corps of Engineers had inspected the site <br />within the last year. <br />RECLAMATION PERMIT COMPLIANCE ISSUES <br />A portion of the lower pond falls within the stipulated 100 foot set-back area from the <br />Arkansas River. The operator agreed to have the pond backfilled so that the 100 foot set- <br />back will be maintained by June 1, 1995. The 100 foot set-back from Maxwell Creek has been <br />maintained. <br />The permit boundaries are marked at this site with fences and poste. The poet marking the <br />south boundary was not visible.
