<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the New Horizon Mine was conducted by DMG staff from the <br />DMG Durango Office, 701 Camino Del Rio, Room 125, Durango, CO 81301, phone <br />(970) 247-5469. Ross Gubka accompanied the DMG inspector throughout the <br />inspection. <br />Mine identification sign and permit boundary markers were posted. Water trucks were <br />spraying the haul and access roads and ramps within the permit area. <br />Pond 007 was discharging through its primary spillway. Discharge was visually <br />estimated at 100 gpm. Primary spillway was clear and functional, debris guard and <br />anti-vortex fin were intact. Pond embankment appeared stable, no evidence of <br />slumping, seeping or erosion observed. Canada thistle and knapweed were observed <br />near the discharge flume and along portions of the pond embankment.. <br />Pit area was active. Reclamation backfill, grading and topsoil replacement appeared <br />current. Irrigation equipment was active for reclaimed areas. <br />The operator has commenced construction and relocation of the county road located <br />immediately north of the active pit area. Silt fence was intact along portions of the <br />ephemeral drainage adjacent to lands affected by the road construction. Lands <br />affected by the road construction appeared stable, no evidence of stumping, sliding, <br />excessive erosion or escaped sediment was observed. <br />
