III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was an aerial inspection flown on November 21, 2006 by Harry Ranney of DMG. Janet Binns of Colorado <br />Division of Minerals and Geology reviewed the digital photos on a computer. This inspection is based on the <br />photos collected during the November 21, 2006 flight. <br />East A-pit is actively being mined. The dragline that had been working the G-dip pit prior to the October 8, 2006 <br />landslide, has been walked North to the east side of the East A pit. <br />G-dip pit is inactive since the "East Panel Landslide". No apparent activity is occurring on the east side of the <br />slide. Buttressing of the H seam on the SE corner of G-dip pit has not begun. The operator has conducted brushing <br />to the south of the slide and grading on the SW area of the East Panel Slide. Brushing to the south of the slide and <br />grading the tension cracks on the southern extent of the slide have been requested in a modification of the 103(K} <br />order issued by MSHA on October 8, 2006. MR210 with the Division provides for brushing of the area south of <br />the slide <br />East Flume pond, East Middle Flume pond, and Middle Flume No. 3 pond all contain water. <br />Investigation and visual monitoring of the East Panel slide remains ongoing. <br />3 Of 7 WHITE -File YELLOW -Operator PINK -Specialist <br />
