III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions Taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This aerial inspection was flown on October 11, 2001. No problems were observed during the <br />overflight. The digital images were reviewed on October 19, 2001. There were indications of <br />standing water due to a precipitation event at [he mine site <br />East Mine <br />Structural demolition continues at the east mine. There are not many structures left that need to <br />be dismantled. The conveyor belt is completely down. Mine equipment and scrap are in piles on <br />the benches. There still is some run-of-mine coal above the crusher/screener bench. <br />The west ridge waste pile pond had a fair amount of water in it. There were no signs of <br />geotechnical instability with the waste pile. Collection and diversion ditches appeared to be <br />functioning. <br />There were no signs of slides or slumps with any of the cut and fill slopes at the east mine. The <br />roads appeared to be passable. <br />West Mine <br />At the west mine, the operator has cut a ditch across the upper third of the disturbed area, <br />bringing that runoff into the sediment pond. The operator has left a large depression in the <br />middle of the lower section of the disturbed area and a berm at the bottom of the disturbed area <br />for additional sediment control. Silt fence appears to be in place below the berm as final <br />sediment control. Silt fence was also installed at [he base of the north facing bench slope as well <br />as just to the east of the topsoil stockpile. There were no signs of any sediment going offsite. <br />There appeared to be a small amount of water in the sediment pond. <br />c:\ms97\bowie 1 \insp 1001 <br />
