III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />General Comments <br />This was an aerial inspection of the Roadside Portals Mine. The site was flown on the morning of 9/26/06, and <br />11 oblique and near-vertical digital images were recorded by Harry Ranney of DRMS. Dan Mathews of DRMS <br />viewed the images on 10/3/06. DRMS conducted a ground inspection of the site on 9/20, 9/22, and 9/29/06 (see <br />inspection report dated 10-2-06), and site conditions described in that report were generally consistent with <br />conditions documented by the aerial images, Weather conditions on 9/26 were clear and dry, and there was no <br />flow in Coal Creek when the imagery was recorded. <br />It was evident from Images 0244 and 0246 that progress had been made on the reconstruction of the CRDA-2 <br />upper diversion ditch, as compared to the condition of the ditch as observed on 9/22. From the images, it <br />appeared that reconstruction and riprap installation along the ditch had been completed or nearly completed, <br />and that track-hoes working along the ditch were roughening the slope adjacent to the ditch that had been <br />disturbed during reconstruction, in preparation for seeding of the disturbed area. <br />The northwest face of CRDA-1 was not clearly visible in the imagery, so it could not be determined if the upper <br />terrace drain maintenance warranted in that location had been performed. Image detail was not sufficient to <br />determine whether maintenance had been performed along the North Portal reclaimed area upper diversion, or <br />whether the gully in the vicinity of the North Portal Area backfilled portal decline (described in the 10-2-06 report) <br />had been repaired. UTL and South Portal Areas were inspected on 9/29/06, and conditions depicted in the <br />imagery were consistent with those described in the 10/2/06 report for those areas. <br />
