M-BfQ99 <br />INSPECTI001 DATE 10-04-94 INSPECTOR'S INITIALS SSS <br />OBSERVATIONS <br />This xas a routine inspection of the Toltec No. 2 Mine, located m the south side of Picaywe Gulch, approximately l0 miles up Cowty Road 110, northeast <br />of Silverton, Colorado in San Juan Cowty. Snow depth m site varied from 0' to 6' but the site xas inspectable. <br />Mining at the site has not progressed very far. The initial cut and bench are approximately 15'x30' xith no evidence of the beginnings of a portal. <br />The topsoil storage pile xas evident m the southxest corner of the site and appeared to be stable with adequate vegetation established m it. <br />The mine ID sign xas in place and incompliance. There xere no affected area markers observed. The operator should install these markers, to delineate <br />the proposed affected surface area of the mine, as described in the approved permit, as soon as the site is accessible next spring. <br />In 1987, the U.S. congress amended the Clean Hater Act to expressly include stormxater discharges fro industrial sites as regxiring Clean Hater Act <br />controls. In 1990, EPA issued regulations that require specific industrial activities to obtain penits in order to discharge stamxater frao their <br />facilities. Active and inactive mining operations xhere stormxater comes into cmtact xith overburden, raw material, intereediate products, byproducts, <br />finished products a waste products located at the mining site are specifically included. The deadline to apply for a Storwater Permit xas October 1, <br />1992. If an approved Stormxater Permit has been obtained, a copy must be submitted to this Division. If a Stormxater Penit fa this mine has not yet <br />been obtained, the operator must make application fa such a permit as soon as possible to the Colaado Department of Health -Hater OualitY Control <br />Division, 4300 Cherry Creek Drive South, Denver, Colorado 80222-1530, and suMit evidence to this Divisim that the application was filed. If any <br />stormxater control structures are required to be constructed at the mine as a result of the stormxater permitting process, a revision must then be <br />submitted to this Divisim to include the operational and reclamation aspects of such structures, including reclamation cost estimates, in the Reclamation <br />Permit. <br />Changes to the Nined Land Aeclamatim Act, due to the passage of Senate Bi1191-177 in 1991, included the removal of the 55000.00 band cap for 110(2) type <br />pereits. Al] mine sites in Colorado are nox required to be bonded fa the actual cost of reclamatim if, in the case of permit revocatim and bmd <br />forfeiture, the state xere to put the reclamatim xork out for competitive Did. Reviex and recalculatim of fhe required bond for reclamatim of this <br />operatim rill take place over the nett fex mmths.A detailed estimate of the recalculated cost, based m the approved mining and reclamatim plans and <br />cmditims observed during the inspectim, rill be forthcoming. <br />There is no evidence of any activatim of the Granger tract under this permit. <br />The inlet of the culvert, xhich directs the flox of Picavwe Gulch wder the mine access road, has eroded such that the road is impassible. A fad of <br />the stream is being used to gain access to the site.
