III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />This inspection was initiated on July 17, and was completed on July 18, 2007. Jerry Nettleton <br />(Nettleton) of Twentymile Coal Company (Twentymile) accompanied Byron Walker (Walker) of <br />the Colorado Division of Reclamation, Mining and Safety (Division) during this inspection of the <br />Foidel Creek Mine. Alicia Thompson was present for a portion of the inspection. <br />AVAILABILITY OF RECORDS <br />Records were checked on July 17, 2007. See the DMG Availability of Records check sheet at the <br />end of this report. All records were found on file. A variance for contemporaneous reclamation <br />needs to be brought forward from a previous permit application package to the current one (Rule <br />2.06.7) (see comment 11 of the check sheet). In addition, there are two access roads for which as- <br />builts have not been inserted into the Permit Application Package (PAP) [Rule 4.03.2(1)(f)(i)] <br />(see comment 18 of the check sheet). An as-built for the recently completed modification of Haul <br />Road A needs to be inserted into the PAP [Rule 4.03.1(1)(d)(i)] (see comment 17 of the check <br />sheet). <br />SIGNS AND MARKERS <br />Signs and markers were in compliance with the permit. <br />ROADS <br />Roads were in good repair.
