III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion.of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Jce Dudash of the Colorado DMG. Colin Stewart <br />represented the operator during a portion of the inspection. Because of the issuance of Succession of <br />Qperator No. 2, all of the mine ID signs need to be changed to reflect the name of the new permittee <br />and operator, Bowie Resources LLC. <br />Coal Waste Pile No. 2 <br />The operator has finished the first lift of coal waste pile no. 2. The outslope of the first lift has been <br />covered with subsoil. The second lift is being formed with the use of two haul trucks, one dozer and <br />two compactors. There were many small piles of coal refuse deposited in rows on the west side of the <br />coal waste pile, for grading and compaction. The east side of the coal waste pile was being graded and <br />compacted. There were no signs of ponded water on the coal waste pile top. The upland diversion ditch <br />and the side ditches were functional. The underdrain was exposed at the reaz of the pile. <br />Although not in progress during the inspection, the operator is excavating subsoil material in advance <br />of the coal waste pile no. 2 Lifts. The operator is still adding subsoil material to the cove~ll stockpile, <br />located just east of the coal waste pile no. 2. <br />The area of the coal waste pile no. 2 drains to Pond F, which had just a little standing water in it. The <br />pond embankment was stable. The primary and emergency discharges are to flow into a notch that was <br />cut into the Deer Trail Ditch culvert. There was irrigation water flowing through the culvert. <br />Main Mine Site Facilities <br />The paved main road was in good condition. However, the operator was doing some repair work on the <br />pavement. The guard rail was in place. The dirt road up to the vent fan also was in good condition. The <br />graveled haul road to coal waste pile no. 1 was in good condition. Road ditches were functional and the <br />road's outer berm was in place. <br />The construction. of the conveyor system to bring coal from the B Seam portal bench up to the D Seam <br />portal bench continues. The wash plant complex is finished. The cut slope behind the wash plant still <br />needs to be seeded. The culverts and ditches in this area were functional as were the culverts and <br />ditches at the entrance to the mine site. However, the inlet to culvert C-B 16, located under the lower <br />road to the engineering office, could use a little maintenance. <br />The operator has recently dewatered Pond B. The water level in Pond B was just above the primary <br />discharge tube. The sediment in the west end of Pond B is getting to be excessive and needs to be <br />cleaned out. <br />c:/word/bowie2/insp 1104 <br />
