III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Marr Strip Mine conducted on August 18, 2004 by Mike <br />Boulay of the DMG. Weather conditions were cloudy with intermittent rain and lightning. <br />Ground conditions at the site were damp. There was no activity at the mine site, and there was <br />no representative from Kerr Coal Company present during the inspection. <br />Roads <br />The permanent light use road that accesses the site was damp but not muddy. The entire mine <br />site was accessible. The light use road was in good condition and maintained. <br />Hvdrologic Balance <br />All site sedimentation ponds were viewed. None of the ponds were discharging water at the time <br />of the inspection. Ponds A, B, and E were retaining a significant amount of water but at a level <br />below the primary spillway. Pond D was retaining a very small amount of water. Sedimentation <br />Ponds C, F, and G were dry. Pond embankments were stable and no problems were noted at any <br />of the pond locations. <br />Reve etation <br />Grasses aze well established at the site and vegetation generally looks good throughout the site. <br />However, grasses aze beginning to turn brown throughout much of the mine site. <br />
