Loc hhead <br />E.ecwice Dnenor <br />nlichael B LnnG <br />Diasion Dueuor <br />DMG has received response to DMG 1/6/97 letter, from Tamara Scheer, landowner of the <br />Soderquist Pit. Please find enclosed, copy of landowner response and DMG 1 /6/97 letter. <br />Response from Tamara Scheer indicate that access to the Soderquist Pit, for reclamation <br />purposes, has not been denied. <br />Annual reports for the operation indicate that the mine has been inactive for more than <br />180 days. However, DMG has not received Notice of Temporary Cessation, as required <br />by Rule 1 .13.5 for any mine which has been inactive for 180 days or more. To resolve <br />this problem the operator must execute one of the following options: <br />la) initiate final reclamation of the site; <br />(bl file Notice of Temporary Cessation, as described in Rule 1.13.5121; <br />(cl submit a request far a Technical Revision to the permit to allow intermittent <br />mining activities as provided under Rule 1.13.7; or <br />Idl re-activate the operation. <br />Options (cl and Id) may not apply if landowner has granted access for reclamation <br />activities only, and not for continued extraction and production activities.
