The
reason for this clarification is that there has been some confusion regarding the difference between 'bonded acreage' or that
amount of acreage on this permit that the operator is not to exceed for bonding purposes (114.8 acres) and 'affected land' as
defined in the Construction Material Rules (see Rule 1.1(3)) or that land that has been or could be disturbed in the future at this
mine site.
It has been determined at this time that affected land at this site includes the Access Road and Roberts Road, Tracts A, B, and
C (State Land Lease Tracts) for surtace and processing disturbances. The affected land also includes all mined or to be mined
lands as outlined on the maps included with TR-05; mining areas G and D. Documents used for this determination included a
letter dated February 8, 1989 which referenced bonding Tracts A, B, and C for disturbance and maps approved in TR-03 that
outlined Tracts A, B, C and Mining Areas C and D and approved by DMG on September 8, 1998.
For the purposes of this inspection, it was determined that the operator had staked the proposed 'bonded acreage' expansion
in Tract A and the proposed 'bonded acreage' decrease below the presently mined area to the east and on the southerly
boundary of the present permit area. Thus, TR-05 could be approved.
In addition, the operator representative wanted the inspector to view areas on the far west boundary of the quarry that have
been reclaimed. These areas were inspected and areas ready for release were discussed. The operator was directed to stake
and define the areas that were ready for release and submit a release request once this had been done. The Division would
then inspect those areas and compare them with the map that would define these areas.
Responses to this inspection report should be directed to Carl Mount at the Division of Minerals and Geology Denver Office,
phone no. 303-866-3863.
I & E Contact Address
cc:
^ CE
NAME: Ms. Lecia Craft p BL
OPERATOR: Pete Lien and Sons.
