The problems should be corrected by the dates given, or they will become possible violations. The possible <br />violations should be corrected by the dates given to reduce their severity when considered by the Mined Land Reclamation <br />Board. The inspector noted on the previous page should be notified of all corrective actions taken. <br />PROBLEMS/POSSIBLE VIOLATIONS <br />AND <br />CORRECTIVE ACTIONS <br />1 ~ nn .rotor hoc diet ~rhed approximately 0 P acres outside of the permit area by mining nn the <br />southeastern edge and stockoilingJnaterial on the western edge of the approved permit boundary in <br />possible violation of C.R.S. 34-32.5-109(1) for failure to obtain a permit prior to engaging in a new <br />operation, or C.R.S.34-32.5-116(41(1) and Rule 3.1.5(3) for failure to protect areas outside of the <br />affected land from damage occurring during the mining operation. <br />CORRECTIVE ACTION: <br />The operator must incorporate the disturbed acreage into a permit by filing an application to convert <br />this operation to a 112 Regular permit. A complete conversion must be submitted to the Division <br />within 60 davs from the mailing date of this inspection report. The conversion application must be <br />completed to the Division's satisfaction within 120 davs, if there are no obiections, or within 150 davs <br />if there are obiections. This Possible Violation will also require a hearing before the Mined Land <br />Reclamation Board on June 14 and 15. 2006. <br />2. Washington County <br />consented to "stabiliz(ing) the topsoil stockpile by establishing grasses on the stockpile during the first <br />growing season following soil salvage" The current site conditions do not fulfill the approved mining <br />plan, since no topsoil has been salvaged to date. <br />CORRECTIVE ACTION: <br />Submit a technical revision to DMG sgeci ing the rationale behind this deviation from the original. <br />approved mining plan. This technical revision shall describe how the operator intends to meet the <br />requirements of C.R.S. 34-32.5-116 (4) (k) since no topsoil has been salvaged: "All affected areas to <br />be seeded or to receive transplants shall be seeded or transplanted using reclamation practices and <br />techniques acceptable to the office.
