<br /> <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the Carbon Junction Coal Mine was conducted by DMG staff <br />from the DMG Durango Office, 484 Turner Drive, Building F, Suite 101, Durango, CO <br />81301, phone (9701 247-5469. Jim Hendricks was not available to accompany the <br />DMG inspector. <br />No activities were observed at the Carbon Junction Mine during the time of this <br />inspection. However, reclamation progress was evident for topsoil replacement of the <br />rock fill area. <br />Signs & Markers Mine identification sign was posted at the mine entrance. Topsoil <br />signs were observed on topsoil stockpiles. Permit boundary markers were observed. <br />Roads Public access is controlled by gate and fence, gate was open. Haul road <br />within permit area is asphalt surfaced. Access roads are gravel/dirt surfaced. All <br />roads were well maintained. Road side drainage ditches and culverts appeared clear <br />and functional. Minor sediment was observed in the road side drainage ditch <br />immediately downslope from the rock fill areas recently graded and topsoiled. <br />Sediment clean-up appeared current. <br />Hydrologic Balance Minor erosion/sedimentation, due to seasonal snow melt, was <br />observed for areas of the rock fill recently graded and topsoiled. Surface drainage <br />from the rock fill area reports to sediment pond for treatment prior to discharge. <br />Sediment Pond 1, located at the far south end of the permit area, was dry, minor <br />accumulation of snow remained. Primary spillway was clear and stable, no discharge <br />noted. Secondary spillway was well vegetated and stable, no evidence of recent <br />discharge. Pond embankment, inslopes and inlets appeared well vegetated and stable. <br />Sediment Pond 2, located along the west side of the permit area, was holding water, <br />water depth visually estimated at approximately 6". Primary spillway was clear and <br />functional, no discharge noted. Secondary spillway appeared stable, no evidence of <br />recent discharge. Pond embankment appeared stable. Rock check dams in the inlet <br />ditch were intact. Evidence of minor erosion and sediment deposition observed in <br />portions of the inlet ditch. However, the pond inlet ditch appeared to have sufficient <br />capacity to function as designed. <br />
