(Page 2) <br />MINE ID # OR PROSPECTING ID #: nn_tegg_pv_A <br />INSPECTION DATE: tn-~'~-Q3 INSPECTORS INITIALS: ~- <br />OBSERVATIONS <br />Completed a partial inspection of this operation as part of the normal requited inspection program. <br />This is an 78 acre 112 Regular permit located about a mile north of Fairplay, west of Highway f. <br />A mine ID sign has been placed at the entrance of the permit area. <br />Could not locate the correct permff boundary markers. The survey markers that were found did not appear to <br />be the correct permit markers (the distances did not match the approved permit map). The operator is required <br />to Install accurate boundary markers as soon as possible since, it appears, the operator may have mined <br />beyond the approved permit boundary. Notify the Division after the markers have been installed so the site can <br />be re-inspected. This is noted as a problem on page 3 of this report. the operator will be given 30 days to <br />correct the problem. If the operator has mined outside the approved permit boundary the Division will issue a <br />Reason to Believe letter (that a possible violation exists) and set the item for a hearing at the December, 2003 or <br />January, 2004 Board meeting. <br />The operator is dumping tree slash (branches, stumps, etc.) in the southern part of the permit area. This material <br />must be removed since the operation is not permitted as a landfill. This is noted as a problem on page 3 of this <br />report. The operator will be granted 60 days to correct the problem. <br />Mining is also occurring in the south pit. Highwalls on the west side of the excavation are near vertical. Product, <br />waste and topsoil stockpiles are located throughout the permit area. <br />Used equipment is being stored east of the weigh scale. This equipment will need to be removed in order to <br />complete reclamation. If not removed wffhin 60 days, the removal costs {estimated) will need to be Included in <br />the financial warranty. <br />The sffe will be re-inspected offer the permit boundary markers are installed. <br />Mr. Steve McEvoy purchased this operation about 2 years ago. The permiffee will remain the same (Sanborn <br />Sand and Gravel, inc.) but the new contact person (the registered agent for the corporation) will be Mr. <br />McEvoy. All enforcement actions will be directed to Mr. McEvoy.
