Enforcement <br />actions resulting from Failure to comply with the Act, Rules and Regulztions, and the permit <br />also are identified belo:a. <br />Roads (4.03) <br />The replacement of culvert C-3 i,~ith a half culvert and grate will improve the drainage <br />gradient and the cleaning capabilities. <br />Two drainage problems were noticed along the county road. There was ponding and no <br />effective drainage along the west side of the county road beti.~een the portal access <br />road and the ranch road. Drainage along this portion of the road is the responsibility <br />of t7re County. The Division suggests that the operator contact the county to maF:e them <br />aware of this problem. <br />The second road drainage problem noticed on September 20th was that the culvert behind <br />the truck scale was completely plugged. By the time cf the second inspection on <br />September 22nd the culvert had been cleaned. <br />~ small pile of road scrapings had been deposited at the entrance to culvert C-3. The <br />pile had been appropriately disposed of at the time of the September 22nd inspection. <br />hydrologic Balance (~S.OS) <br />The diversion ditch above the portals was inspected. The berm was much more substantial. <br />The system should now function properly. <br />The operator stated that the elevation of GOo maximum sediment storage volume c,~ould be <br />calculated for the sediment pond. This elevation will then be used to determine rohen <br />the sediment pond needs to be cleaned. <br />Revegetation (9.I5) <br />The outslope of the ditch around the coal stockpile and the areas of erosional problems <br />on the hillside near the portals need to be seeded. (See section IV of this report). <br />Other <br />Near the intersection of the ranch road and the county road is an area (20' x 20') with- <br />in the pernu.t area that was disturbed by previous mine operations. Several steel Z beams <br />and miscellaneous metal items are stored in this area. The operator confirm?d that part <br />of this material might be used by the Apex hfine. Zf an area is rcdisturbed by the <br />current operations, responsibility is assumed For reclamation. (Sec section ZV of this <br />report fora further discussion.) <br />Ili I Y~~~ ;J .: ~I <br />
