III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />Therefore, NOV CV-2005-002 was terminated. A copy of the termination notice is included in this inspection <br />report. <br />The operator has done an excellent job of grooming gob'pile no. 2. The top of gob pile no. 2 had positive <br />drainage and drainage collection and diversion ditches and the underdrains were functional. The operator stated <br />that a lot less coal fines from the wash plant were being taken to the gob pile. Instead, the fines aze being <br />shipped out with the coal. <br />No problems were noted at gob pile no. 1. Collection and diversion ditches were functional. The pile was dry <br />with no ponding of water on top of the pile. The haul road leading to the two gob piles was in very good <br />condition. The road berm was intact and the road ditches had sufficient capacity. <br />The water level in Pond C was just above the primary. The gated valve was closed so there was no dischazge. <br />There was only a little water in Pond D. Pond F was dry. Emergency spillways were functional, with the riprap <br />in place. Surface disturbance markers were up around the sites. No problems were observed with the coverfill <br />stockpiles and the topsoil stockpiles in this general area. Straw bales were in place at the pump house. <br />Unit Train Loadout <br />A unit train was on site but the site was very clean, with no problems of fugitive dust observed. The bench <br />outslope was well vegetated and appeared to be stable. Collection and diversion ditches were in place and <br />functional. Ponds J and K were dry. Pond embankments were stable and primary and emergency spillways were <br />functional. The main topsoil stockpile was well vegetated. <br />One of the culverts under the railroad tracks on the west side of the adjacent Terror Creek Loadout needs repair. <br />A small amount of irrigation water in the Deer Trail Ditch was flowing into the culvert, but not exiting. <br />Inspection by Bowie personnel revealed that there was a gap between the pre-existing culvert and the culvert <br />extension that Bowie constructed for the train loadout siding project. Instead of coming out of the culvert outlet, <br />the water appeared to be piping just below the surface and coming out at the base of the railroad track siding <br />bench outslope. There did not appear to be any threat to slope stability because of this leak. Bowie was <br />implementing immediate repairs to this culvert. <br />Records <br />The records were in compliance, as documented in the attached records checklist. <br />c:/word/bowie2/insp0605 <br />
