III. COMMENTS -COMPLIANCE <br />Below aze comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DMG. No one <br />represented the operator during the field inspection. There was no activity on site. <br />West Mine <br />There was only a little water in the lower pond. The upper pond was dry. The gated valve <br />on the lower pond needs to be closed. The gated valve on the upper pond does not close <br />completely but the dischazge goes into the lower pond. The ponds' embankments appeaz <br />to be stable. No vegetation has taken hold on the reclaimed azea or on the pond inslopes <br />and outslopes, but no gullying is evident, The silt fence at the down gradient end of the <br />reclaimed azea and in the azea just to the northwest of the upper pond wifl need <br />maintenance soon. The ditch and culvert that are close to the former portal bench <br />entrance gate will need maintenance soon due to rock falls. <br />Well Field <br />The mine ID sign and the topsoil stockpile sign were up. There was no gullying on the <br />topsoil stockpile, which had a moderate vegetative cover. <br />ROM Pile <br />There was a little water in the pond. The pond embankment was well grassed and <br />appeazed to be stable. The pond spillways were functional. The berm on the outside edge <br />of the run-of--mine (ROMJ pile needs repair in one spot. Runoff water has "gone over the <br />edge and down the grassed slope. The runoff water goes to the pond but the waste <br />material should be kept off of the grassed slope. The collection ditch had capacity. <br />The topsoil stockpile sign needs to be put back up. There were no gullys on the topsoil <br />stockpile.
