(Page 7) <br />MINE ID it Of: PROSPECTING ID p M-1989-029 <br />INSPECTION LATE 3/28/00 INSPECTOR'S INITIALS CLK <br />5) Reclamtt[iori problems: (pictures) That the reclamation is not yet complete, despite the completion of other, similar projects <br />in the area which were begun after the CAMAS operation begun. <br />Reclamation permits within the State of Colorado are open-ended and do not have an enforced end date for minine and <br />reclamation. As long as the site is being actively mined or reclaimed with no problems that would lead to permit revocation, <br />then the permit can remain active for an indefinite period of time. C.R.S. 34-32-I 16(7)(q), noted by the complainant, merely <br />states that "upon [emanation of the entire mining operation and in accordance with the reclamation plan, each phase of final <br />reclamation shall be completed prior [o the expiration of five years after the date on which the operator advises the Board that <br />such phase itas commenced, unless such period is extended by the Board." <br />Pictures: <br />1) Picture of the pipeline near the concrete/asphalt piles, and the water pooling in the area. <br />2) Pictures of "dead trees along the St.Vrain next to C& M". <br />3) Picture of a fuel spill near a pump, as well as a small fuel tank which does not have proper containment. <br />4) Various other pictures of reclamation completed at sites under other operators. <br />Water does fool in the area where the concrete and asphalt is stored, but no evidence of direct discharge from this area to the <br />St. Vtain ca~~ be found. <br />No evidence: of fuel spills was found during this inspection. One fuel tank inside the processing area (near the asphalt plant) <br />was not in a berm, but Mr. Helm was not certain whether any material was being stored in it. Testing of the tank and submittal <br />of the result:; to DMG should be done within 30 days, and if the tank contains fuel or waste material, it must be placed in a <br />berm or tank. (see PB2) <br />6) Future Mining Plans: That the permit had been amended several times, and there is apparently no end in sight; questions of <br />what will happen with the conveyor belt is to be installed; that CAMAS is currently negotiating for another perrnit. <br />Permits may be amended as many times as needed in order to comply with the Colorado Surface Mining Act and the <br />Construction Materials Rules and Regulations. CAMAS Co., Inc. is currently an operator in good standing with the <br />Division of Minerals and Geology, and as such, may hold as many permits as they wish, provided they comply with all <br />applicable rules and regulations and post sufficient financial bond to cover the cost of reclaiming all the sites which they <br />have permits to mine and reclaim. An amendment to this permit will be submitted by CAMAS for the conveyor belt in the <br />future, at wftich point members of the public will be free to comment on the proposed corridor, and DMG will require that <br />the new area comply with all applicable rules and regulations. <br />i & E Contact Address <br />NAME Mark f{elm. <br />OPERATOR t:AMAS CO.
